Philip J. Berg is an attorney and former Deputy Attorney General of Pennsylvania who gained national attention for his lawsuit against Barack Obama.

Berg’s suit contains a collection of the main issues of Obama conspiracy theory from fake birth certificates, flights to Africa and Grandmother tapes to Indonesian naturalization. Much of what appears on this web site passed at one point or another through the federal lawsuit Obama v Berg et al.

Berg describes himself as a Democrat. Unconfirmed reports on the Internet say he is a member of the NAACP or an officer of that organization.

While new to this writer, Philip Berg should not be new to seasoned conspiracy theory investigators because of his involvement in a lawsuit against George Bush to get the truth about the 9/11 attacks.

Berg wrote:

Now, it is time for world leaders to take the lesson learned from Iraq and issue a warrant for the arrest of George W. Bush and Richard Cheney; arrest them; take them to a neutral country; try them for the murder of over 2,800 people from more than 80 countries on 9/11/01 and, when found guilty, sentence them appropriately.

Finding that the Pennsylvania lawyer had committed a “laundry list of unethical actions,” a federal judge has imposed more than $10,000 in sanctions and ordered the lawyer to complete six hours of ethics training, according to law.com. Judges order.

    Personally, I think Berg is well aware he has a “dead horse”, but that “dead horse” is still raking in lots of $$$$$$$$$. As long as the $$$$$$$ keeps coming, I suspect Berg will keep “riding that dead horse”. Doesn’t cost much to feed him. LOL

    As fyi, in an unreported (and unremarkable) April 17, 2009 opinion, the Third Circuit Court of Appeals upheld the Rule 11 Sanctions imposed against Berg in Holsworth v. Berg (2005 case).

    Conclusion of unreported decision reads:
    Berg does not challenge the determination to impose sanctions. Rather, he challenges the severity of the sanction, contending that the amount assessed was excessive. We cannot ignore, however, that despite notice of the amount sought, Berg never challenged the severity of the sanctions imposed. In the motion for reconsideration, Berg sought to excuse what he perceived as the reason for the sanctions, but he did not contend that the sanctions were excessive. In Newark Morning Ledger Co. v. United States, 539 F.2d 929 (3d Cir. 1976), we observed that we “generally refuse to consider issues that are raised for the first time on appeal.” Id. at 932. “This general rule applies with added force where the timely raising of the issue would have permitted the parties to develop a factual record.” …Accordingly, we will not disturb the sanctions imposed by the District Court.

    Judgment imposes costs on Appellant (Berg).

    This as Phil got the bad news that his Rule 11 sanctions appeal in Holsworth v Berg was denied in the PA 3rd Circuit Court. The court said:

    Other attorneys should look to Mr. Berg’s actions as a blueprint for what not to do when attempting to effectively and honorably perform the duties of the legal profession.

    Berg’s going to have to pay about $10K in damages and take ethics training.

    Until about ten years ago, Phil Berg was a respected lawyer here in Montgomery County. He began a precipitous decline around that time which has seen him lose his once-thriving litigation practice, his office building, his political standing (once a well-connected Democratic committeeman), and recently, his house. There’s something going on with him and he won’t let anyone help. This lawsuit is just the most recent escapade. No one around here took it seriously, once it was known who filed it, no more than we took it seriously when he demanded, in 2001, the disbarment of Scalia, O’Connor and Thomas. Nor did we take it seriously when he sued Bush and Cheney for bombing the Twin Towers. Yes, he did! Funny, I don’t see the wingnuts embracing THOSE lawsuits…

    Amazing isn’t it amazing that the Democratic Party missed this when nominating him for President?
    Could this be a genuine smoking gun about this controversial issue?

    What most people know is that the Associated Press (AP) is one of the largest, internationally recognized, syndicated news services. What most people don’t know is that in 2004, the AP was a birther news organization.
    How so? Because in a syndicated report, published Sunday, June 27, 2004, by the Kenyan Standard Times, and which was, as of this report, available at

    The AP reporter stated the following:
    Kenyan-born US Senate hopeful, Barrack Obama, appeared set to take over the Illinois Senate seat after his main rival, Jack Ryan, dropped out of the race on Friday night amid a furor over lurid sex club allegations.
    This report explains the context of the oft cited debate, between Obama and Keyes in the following Fall, in which Keyes faulted Obama for not being a natural born citizen, and in which Obama, by his quick retort, So what? I am running for Illinois Senator, not the presidency, self-admitted that he was not eligible for the office. Seeing that an AP reporter is too professional to submit a story which was not based on confirmed sources (ostensibly the Obama campaign in this case), the inference seems inescapable: Obama himself was putting out in 2004, that he was born in Kenya .
    The difficulty in finding this gem of a story is hampered by Google, which is running flak for Obama: because if you search for Kenyan-born US Senate you wont find it, but if you search for the phrase without quotes you will find links which talk about it…

    Hanen of Sentinel Blog Radio broke the public news of the existence of this AP story at on October 14, 2009 at 12:31 PM. However, The Post & Email can confirm that a professional investigator had uncovered this story months ago, and that certified and authenticated copies of this report, meeting Federal Rules of evidence, have already been prepared and archived at many locations nationwide.

    A Chronology of Deceit
    One can now ask an important question which has not yet been emphasized enough: Just when did Obama begin to publicly claim he was born in Hawaii ? This question is distinct from the question, Just where in fact was Obama born?, and from the other question, What do official documents say about where he was born?
    Regarding his claims, we can summarize what is known:
    1. As of Monday, Aug. 28, 2006, Obamas Campaign was putting out that he was born in Hawaii . This is known from the introductory speech given by Prof. George A. O. Magoha, Vice-Chancellor of the University of Nairobi , on the occasion of a speech given there by Senator Obama that day. (One presumes that the Vice-Chancellor was given notes from the Obama campaign, as is customary on such occasions)
    2. From the newspaper reports above, it is clear that the Obama campaign was putting out that he was born in Kenya , or overseas, during the period of June 27, 2004, until January 8, 2006.
    3. In October of 2004, during the ABC Chicago Affiliates broadcast of the Obama-Keyes debates, Obama openly admitted he conceded that he was not a natural born citizen. (C-Span aired the uncut version of the debates, which contained this exchange, in the second half of April, 2005)
    4. It is known from a classmate of Obama at Harvard University , that while at Harvard, Obama at least on one occasion admitted that he was born in Kenya . (This friend went on record on a call in radio program in Idaho in early July, 2009)
    If any reader can find a link which documents a claim to a birth location before Aug. 28th, 2006, which differs from this timeline or which supports it; please let The Post & Email know of it, by posting it in the comment section below.
    In a follow up report, The Post & Email has published a brief analysis of the Google Newspaper archive, which shows that Obamas story changed after June 27, 2004.
    Finally, that the AP did cover this story, reprinted by the East African Standard, can be seen from the citation made to AP stories about it (Jack Ryan dropping out of the race), in the following contemporary news articles, which however are incomplete:

    You’ll accept the mistake of a foreign newspaper over the word of the Republican governor of Hawaii and the head of that state’s Department of Health?

  9. The original AP story didn’t have Obama being born in Kenya. The Kenyan paper added that little touch, and retracted it later.

    The rest is unsubstantiated rumor.

    It is a chronology of deceit though, but by Obama’s opponents.

    The AP says they didn’t put Kenyan-born on the article: “The AP has never reported that President Obama was born in Kenya. In fact, AP news stories about the state of Hawaii have confirmed that he was born there. The Kenyan paper that you cite rewrote a 2004 AP story, adding the phrase ‘Kenyan-born.’ That wording was not in the AP version of the story.” Link

    Well, in that link (which has the correction right up at the top), it originally said he was born in Indonesia, not Kenya.

    No, I watched the tape. In the debates, Obama said “I’m not running for Minister of Illinois, I’m running for Senator.” Keyes also says the running for president line never happened. Keyes never put it into his lawsuit.
