In oral arguments [audio] [video] May 2, 2011, before the 9th Circuit Court of Appeals, Assistant US attorney David A. DeJute representing President Obama in the case of Drake v Obama, made this statement:
There have been a series of cases that Ralph Nader has brought in challenging qualifications of other candidates. He’s done so during the course of the election. [emphasis added]
In a letter to Mr. DeJute, Nader’s attorney categorically denies him ever having brought such suits:
Please be advised that Mr. Nader has never initiated a legal or administrative proceeding to challenge the qualifications of any candidate for public office. … In addition, in furtherance of his advocacy for a more robust and competitive democracy, Mr. Nader has successfully challenged laws restricting ballot access and limiting voter choice. …
So there.

I believe that Mr Nader is correct in this case, and the government’s statement was inaccurate. The count of inaccurate statements in court filings is now: Birthers 456,723, US Government 1
does anyone know if nader’s parents naturalized before he was born?
The only candidate related actions I recall was Nader trying to get himself into an FEC-run Presidential debate. How did Nader get involved in this case? First reference I have seen of Nader in anyway associated with all this.
Nader is only involved insofar that the Government misrepresented Nader and Nader wrote the attorney who made the mistake a letter about it. Significantly, it was the Government who filed this correction with the Court, thereby correcting the record. One never sees birthers admit error like this.
