Birther Ballot Challenge menu feature

I’m working on organizing all of the documents for the various state birther ballot challenges into an easy reference (a bit like I did the Birther Bills before). Look under the Docket menu above for 2012 Birther Ballot Challenges. Alabama and Arizona have entries so far.

It’s really slow work searching for the documents and removing duplicates. If anyone would like to volunteer to send an HTML file with links for a state, let me know using the Contact link. At least after 2012 there won’t be any more ballot challenges for Barack Obama.

I see that NBC has something similar to what I’m doing, but it doesn’t have all the documents, and the Fogbow has some pieces too, but not complete. ObamaBallotChallenge.com also has omissions and is not very up to date. So some duplication of effort as always. 🙁

    Not sure if that is because this site goes down more than a 5 bit whore or because you just feel my comments are inappropriate.

    I don’t much care actually, as anti-birthing is not my full time job and it certainly can’t be pursued on a site that is down 40% of the time. But curious.

    Doc, this is a bit off-topic, but I want to thank you for maintaining this site. I glance at it most mornings to see what’s new in the crazy birther world. I first look at the NYT, then ThinkProgress and Right Wing Watch; they tend to leave me depressed and angry at what’s happening to our country. Then I come here, and my spirits are immediately lightened; because this is so insane that becomes entertaining.
    Of course birtherism could become dangerous if some militia fanatic out there starts acting on what he (or of course she, but women tend to be more sensible) reads on WND, but we can only hope for the best. In 2016 it will be over — until the next “different” guy comes along: Latino, Asian-American or even — credo quia impossibile — a secularist, someone who does not adhere to any religion.   15. The fact that Obama was born with dual citizenship was widely known and widely reported prior to the 2008 election. Pelosi knew it, I knew it, The Congress who certified the 2008 election knew it, and Supreme Court Chief Roberts who swore Obama in knew it. Apparently their understanding of the Constitution differs from yours.

    There have been periodic attempts over past decades. to offer constitutional amendments that would allow foreign born adoptees to run for President, largely sponsored by Republicans. They never went anywhere.

    I would advise against using uncommon jargon (“OCONS”) on this site cause we won’t know what you’re talking about.

    Under German law, Ron Paul might be German

    So you will have to choose between one or another dual citizen. Unless you refuse to vote for any candidate of white, black or Asian ancestry and go with a real American- a Mohawk, Navajo, Sioux or Cherokee (which is fine with me).

    As for the founding fathers, they lived in a world where crossing the ocean took weeks not hours and was dangerous and uncomfortable. They didn’t have penicillin, computers, cars, air conditioning, central heating and almost everything you use in your daily life. Basing your life on theirs is a foolish quest. This is 2012, not 1788.

    Because of the circumstances of Obama’s birth, we need not look at article 14, but need to check page 190, where number 30 refers back to the old articles 87 and 88 of the 1969 constitution.

    (2) would have acquired citizenship if Article 87 (2) read as follows:
    “Every person who, having been born outside Kenya, is on 11th December, 1963 a citizen of the United Kingdom and Colonies or a British protected person shall, if his father or mother becomes, or would but for his or her death have become, a citizen of Kenya by virtue of subsection (1), become a citizen of Kenya on 12th December, 1963.”

    So, you need to have a look at the old constitution of 1969,

    where the old article 87(2) actually said:

    “(2) Every person who, having been born outside Kenya, is on 11th December, 1963 a
    citizen of the United Kingdom and Colonies or a British protected person shall, if his

    subsection (1), become a citizen of Kenya on 12th December, 1963.”

    So, the only cahnge here is adding the word “mother”. Of course, Obama was also a US citizen by virtue of his birth in the US, so he was also hit by the provisions of article 97 of the 1969 constitution:

    97. Dual citizenship.
    (1) A person who, upon the attainment of the age of twenty-one years, is a citizen of
    Kenya and also a citizen of some country other than Kenya shall, subject to subsection
    (7), cease to be a citizen of Kenya upon the specified date unless he has renounced his
    citizenship of that other country, taken the oath of allegiance and, in the case of a person
    who was born outside Kenya, made and registered such declaration of his intentions
    concerning residence as may be prescribed by or under an Act of Parliament.

    Surprise, surprise, the new constitution of 2010 allows dual citizenship.

    This means that anyone born of a Kenyan mother outside Kenya before Kenyan independence is now by virtue of the 2010 constitution a citizen by birth of Kenya (and no, Obama’s mother never became Kenyan).

    There is some anti-male discrimination here, as people in Obama’s case had to renounce the other citizenship to remain Kenyan.

    It therefore comes as no surprise that the 2010 constitution has an article 14(5) which says
    (5) A person who is a Kenyan citizen by birth and who, on the effective date, has ceased to be a Kenyan citizen because the person acquired citizenship of another country, is entitled on application to regain Kenyan citizenship.

    [not sure whether this article really applies to Obama or anyone who was born with dual citizenship even after 1963]

    and also gives Kenya’s Parliament the power to enact laws

    (a) prescribing procedures by which a person may become a citizen;

    (d) providing for voluntary renunciation of citizenship;
    (e) prescribing procedures for revocation of citizenship;

    (article 18, pages 18 and 19).

    So it all boils down to whether the Kenyan Parliament will enact a law granting citizenship automatically. That is not much different from North Korea granting North Korean citizenship to all Americans over the age of 35.

    I apologize if this sounds confusing. IANAL, but I think I can safely conclude the new constitution did not make Obama a Kenyan citizen again.

    Newsflash to WOPRjr (is that anything like WOLD): Anyone Jewish in the entire world, is automatically an Israeli citizen the moment they set foot on Israeli soil.

    Case in point: My maternal uncle was a world class authority on inorganic chemistry, and was invited to lecture for a year at the Technion. While there, his daughter (my first cousin) turned 17. The day after her birthday, she was drafted into the IDF. She never took any steps for Israeli citizenship. 17 is the age of majority in Israel.

    Eisenhower was born a German. He lost nominal German citizenship (meaning the right to apply for a German passport) when he entered the US Army. He did not president while German. Unlike Thomas Jefferson who presidented while French, and Agnew, who presidented while Greek.

    Some people believe that because Ike’s ancestors immigrated long before 1776 or 1787-1788 (June 21, 1788 was when New Hampshire ratified), some Mayflower-like NBCship was miraculously imbued into their genes. That is incorrect, as no German ancestor of Ike was born in the colonies; Ike’s immigrant ancestor fathered the next generation of Eisenhowers at the age of 72 well in the 19th century.

    Ike lost nominal German citizenship at the same age as Obama lost nominal Kenyan citizenship. He could have applied for actual German Bundesrepublik citizenship later in life. Like Obama now, according to the new Kenyan constitution.

    There are more parallels between Eisenhower and Obama (though the claims about a name change and an incorrect place of birth on the BC have been found true in Ike’s case, and wrong in Onama’s case). It may look like a funny coincidence, but it really is not. The United States being a nation of immigrants coincidences like that are bound to occur when you have 44 presidents. It is like that statistical question about how many people you need at a party for two of them to share the same birthday.

    The repeated references to both the prior v. Bowen Birther cases and the Ankeny decision offer further proof that the only thing that the Birthers have succeeded in doing is solidifying the citizenship and ballot access legal precedents AGAINST them.

    Based on this response, I would expect the Court to summarily dismiss these claims with only a sentence or small paragraph at most.

    I would like to think that Pamela Geller should be ashamed to be a shonde, and have her wreck of a site called a hate site by the SPLC.

    This birther nonsense is just another version of the Red Scare. The theme is the same; just the characters have changed. The Soviet Union is no more, so they can’t call Obama a communist. Instead, he’s a Marxist and a socialist, and hates the UK because of their colonies.     Same here. Obama will have books written about him, and a dedicated library. The birther crowd will be a footnote.

    When I was growing up, and drifted into anger, my mother, aleha ha shalom, would say “stop licking your wounds.” That was after all that had been dished out to us. Same thing when I came home from school, and repeated a superstition or old wive’s tale. She would always say “stop that. There’s a scientific explanation for everything.”

    Excellent advice.
