Arpaio impedes Taitz prosecution

Peter Boyles, KHOW talk radio host in Denver, featured birther attorney Orly Taitz on his show this morning, confronting her elusive witness, John Sampson. The Denver Post said of Boyles:

The Internet aside, the 630-KHOW radio host is easily the top source for birther flame-fanning in Colorado.

Taitz described her historic court trial in Indiana Monday as a “trial against Obama” (Barack Obama isn’t a defendant in that case). Taitz said, “There are 30 million people who read my web site and they are extremely angry [at John Sampson],” so show producers called John Sampson, former Taitz witness in Georgia, to ask him why he’s not going to appear in Indiana for Taitz. This is what he said (from recording after 19:45):

A couple of things, Peter: Number 1, as you know and as your listeners know, I’ve got my own political race that I’m in the middle of, and quite frankly the polling data that we have shows that it’s a statistical tie. Every minute that I take away from the campaign, I have more catch-up to do later on and it adversely impacts my chances getting elected to the Colorado State Senate. That’s item 1.

Item 2 is on March 26, 2012, I was down in Phoenix, Arizona, and met with Joe Arpaio and his crew. And at that meeting I was instructed, because there’s an ongoing criminal investigation, that they would appreciate it that if I didn’t testify at any other hearings. Because of the information that I became privy to as a result of that meeting. Once I get on the witness stand, lord only knows what questions are gonna be asked. And as a result, I’ve been in touch with Mike Zullo who is the lead investigator for this thing and none of us are going, and I understand where Dr. Taitz is with this, I really do, and I applaud her efforts, but I’m in a bind right now where I cannot …

Taitz: This is complete nonsense! …

Peter Boyles: Orly, Please…

Taitz: let me finish; let me finish …

Boyles: Orly, Please…

Sampson: Peter, If you can’t put a muzzle on her, I’m gonna hang up.

Just wow! Arpaio shares with an out of state civilian critical details of an ongoing investigation, but tells him to keep it out of the hands of the courts. I must side with Orly Taitz when she says John’s second point is nonsense. Anything Arpaio told him is hearsay and inadmissible. Boyles says that Taitz and Sampson are both “friends” but he clearly likes Sampson best.

    I listened to the show and I thought Peter Boyles treated you badly. I completely agree with your point that John Sampson’s objection to having to reveal confidential information at the Indiana trial is utter and complete nonsense.

    First you wouldn’t have even known that he had met with Arpaio if he hadn’t told you himself, and so you couldn’t have asked him about it (and the Indiana Secretary of State certainly isn’t going to ask him anything like that). More importantly, anything Arpaio had told Sampson would be hearsay and would not have been allowed in the first place.

    That said, there are lots of folks who believe nonsense, and Sampson will get away with it.

    I disagree with your theory that Arpaio did a deal to forgo prosecution of Obama in exchange for a deal on criminal charges against him. Arpaio clammed up because he wants to be re-elected, and the majority of voters are not in sympathy with the Obama eligibility challengers.

    I talked personally with Sampson at some length after the Atlanta hearing, and I thought he was a half-way decent fellow, but now that Sampson has his political career started, he’s dumped you. Pretty sorry treatment if you ask me.

    It wouldn’t make any difference whether Samson is not appearing due to some agreement with Arpaio or whether he just doesn’t want to expose himself to cross or whether he just doesn’t want to do anything for Orly or just doesn’t want to go to IN. If he doesn’t want to appear he doesn’t have to, even with a properly served subpoena, and the court has no power, under the circumstances, to force him to. And no, he won’t be held in contempt. The same holds true for Arpaio and Zullo.

    The real reason they won’t testify, in my opinion, is because they don’t want to be subjected to cross exam which would blow all their BS “investigation” out of the water.

    I lived in the Denver area for most of the 80s. Boyles was a responsible, respectable talk show host in those days. He was a friend of talk show host Alan Berg, who was murdered by white supremacists in 1984. How he devolved into becoming a birther is a mystery to me.

    TYPO. In the second paragraph of Sampson’s direct quotation, in the second line should read (from the radio tape):
    ” I WAS instructed, because there’s an ongoing …..”

    The “was” erroneously omitted.

    She does have a strong tendency to turn on even those who supporter her. The trail of birthers, or lean toward birthers, she has left in her wake is constantly growing. If I recall the list:

    some of her Keyes v Obama clients

    Larry Sinclair
    Dean Haskins
    And some from the crew of Liberi v Taitz.

    I suspect, I am missing many but it is hard to keep up.

    That’s because, in Orlyville, you eaither support her 100%, or you are one of her mortal enemies (I assume I’m somewhere on the list).     Yes, but it might prove embarrassing if the defense asked him about it, Orly of course does not object (because she *wants* all this stuff in court) and Sampson says something that might be devastating to Arpaio’s show – like “they said they are doing this for political purposes”.

    Perhaps nothing, as the defense has now filed a Motion to Dismiss the First Amended Complaint. That “should” be heard before any “trial” ensues on the Motion for Permanent Injunction (a preliminary injunction having already been denied) and the other motion that is the subject of the “trial” which is asking that Obama be kept off the ballot or in the alternative tnat no votes be counted in IN unless and until all Orly’s “evidence” is heard and the original BC is examined by experts, etc.

    Aside from Arpaio, Zullo and Sampson she claims to have 7 witnesses going to IN to testify. Strunk in esse has declared his intention to testify related to “Soebarkah” and Orly claims Susan Daniels is going. No idea beyond that.

    Bottom line, none of the evidence is probative and most should be inadmissible hearsay, even if testimony is allowed.

    Judge Reid has invited the birther circus to town, ala ALJ Malihi. I think it is possible she’ll hear the Motion to Dismiss arguments, withhold ruling and go ahead and hear Taitz’s “witnesses”, which is in effect trial by ambush, as the defense has had no discovery opportunities as to Taitz’s “witnesses”. Now, it won’t matter much as all the testimony is BS, but there will be objection to any/all of it as this will not be tried to an empty chair.

    Should be interesting. And entertaining.

  21. That’s good. One of the reasons I decided not to go was the uncertainty that anything would happen in the first place, and the hopes that some valiant anti-birther would attend and provide a report.

    I remember being in Atlanta when the hearing was almost canceled due to the non-appearance of the Defense.

  31. It is not surprising that more than one birther would choose some form of their hero Emer de Vattel’s name. I would say with certainty that very few of them have read very much of his writings. The majority of what he wrote is not pro-democracy.

    Papit may have been Emer de Vattel on Facebook. The old Orly’s World page got removed by Facebook so I do not think it is archived. the first time I had ever heard of Papit was when he was connected to the name over there.

    Yes, It took me a while to figure it out, but he and I had gone through many conversations in private and the way he phrased things was a dead give away. He admitted it to me later.
