Cold Case Posse plays fast and loose with the law

Despite dubious claims of being “law enforcement,” the Maricopa County Sheriff’s Cold Case Posse doesn’t act like law enforcement, but more like someone trying to evade the law.

Case in point is their obligation under federal law to provide certain information regarding their IRS tax-exempt status. When I asked for the legally required information in a registered letter, they refused delivery (didn’t sign for the letter at their PO Box) and when they finally responded to someone else, they redacted parts of the filing, not complying fully with the law. Here are some of the redactions:

At least two complaints have been filed with the IRS regarding the CCP tax exempt status, one documenting that their primary activity is political, and one filed by me that their independent status conflicts with their exemption from filing financial disclosure forms.

A second matter is the recent discovery that those county government “G” license plates on Posse cars are not registered to the county, but to the Posse itself. Irregularities with the Posse and it’s vehicles have been referred to the state auditor.

Now a third complaint has been filed with the Arizona Corporation Commission. The full story appears in an April 22 article at Arizona’s Politics. The complaint was filed by former Posse member Brian Reilly, well-known to readers of this blog. Reilly alleges that filings with the Corporation Commission were altered around the time the Posse went into the Evil Obama business (my phrase) to obscure the current addresses of those who run the Posse.

Arizona law requires the street address be provided for a corporate address, and the 2011 filing does contain a street address of sorts (and the same address is listed for all corporate officers and directors).

Here’s what is located at that street address:

Photo of post office

It’s the Daisy Mountain post office at 44047 N 43rd Ave.

The only real address on the form is the “physical address” of Mike Zullo, in his capacity as registered agent, and that address belongs to the Sheriff’s Office, where Zullo has box where he can pick up mail without signing for it. It appears that this exercise in obstruction might be to prevent delivery of registered mail to him, or maybe Zullo is acting paranoid.

Dear Mr Zullo, since we know you read here and keep up with us…you might want to consider a little piece of advice. You might wish to close up the CCP shop and end the sham investigation pretty soon. All these little nuisances in and of themselves may seem to be just a bump in the road now, but they are starting to add up to something you really don’t want. Pretty soon the IRS is going to want to see your personal finances, as well as all the records from the CCP to make sure you have been using donations as they were meant and not for personal use. You want to see a REAL investigation at work, it will be against you…and it won’t be pretty. Very simply, if you close it down now, you’ll probably be able to skate by. If you keep on going till the mid-terms, you’re probably going to find yourself in really deep doo-doo. Your choice, because you know by now your sham investigation is NOT going to get the President. Just my 2 cents for you.

Mr. ZuLow, don’t listen to Jim. He is not your friend, like me !

    Double down !

… or maybe Zullo is an experienced confidence man.

Between all this negative press the CCP is getting as of late, and LDS’s little house of lies crumbling, I forsee a huge increase in puff pieces and “We’re SO close!” damage control articles at BR, in the immediate future.

Ending the sham is good advise for Mr. Zullo. In the end, though, it won’t protect him and all the other officers and directors of the corporation from personal responsibility for the organization’s mismanagement and possible misdeeds since it was founded in 2007.

Until the posse reveals its finances reasonable people will wonder what is being hidden.

  6. Bonsall Obot says:

And if two or more are acting in concert to unlawfully hide these unlawful acts… well, there’s a word for that.

EDIT: And an acronym, too. Ask Orly.

  7. Curious George says:

Mr. Zullo. Which part of the “Daisy Mountain” Post Office is used for your office space? Is it the lobby? Is it a reserved parking space where your desk sits? Do you have unmarked Post Office trucks with government plates? Do you have a Post Office gas key? Do you get free postage stamps for your birther solicitations? Have you redacted your government vehicle plates as well? And this is all okay with Arpaio?

I’ve always found a quick trip to BirtherReport entertaining.

    Today it’s just downright crazy.

  9. Thinker says:

I’m confident that neither the mid-term nor any other election will factor into any decision the IRS makes regarding the Cold Case Posse. Suggesting that it will is just feeding the wingnut fake outrage machine about the fake “IRS targeting teabaggers” scandal.

You’re reading too much into it, by keeping it going longer it seems that more and more things that they are doing wrong (and possibly illegally) will keep on popping up. Such as the cars, the lack of oversight, etc, etc, etc. If he shuts it down now, nobody will probably care enough to worry. If he keeps it going, who knows how many other misdeeds and illegal activities others might uncover and report about the CCP. The IRS does not care about elections, but Zullo might.

I find that the crazier Birther Report is, the more entertaining I find it. It’s like an adult “show and tell” assignment over there with all their pictures and the primary theme of every thread is name-calling/ad hominem attack.
They never have a serious discussion of issues and they act like frightened little children when it comes to debate.

I know. It was like that “store closing” sale at one the K-marts in town. Complete aimless scrambling about.
Half the people there were flipping out because it was a closing sale, and the other half was flipping out, because they realized they wandered into a K-mart.

People like Volin repeating and exaggerating Zullo claims is just making it worse for them. Yesterday on the KFAB Chris Baker show Volin claimed that the MCSO had people in Hawaii for months looking at records. He didn’t say the cold case posse but rather that the Sheriff’s office itself did this. If any of this were true then taxpayer resources would have been used illegally more than they already are.

  20. Arthur says:

CarlOrcas: It seems to me like they’ve kinda slipped over the edge and they don’t know where they’re going.

Like this guy, “Barry Soetoro,” who has been obsessively posting anti-Obama photos, and who left his crazy nugget:

“Half a decade under the oppression of Odildo has honed my Spidey senses. Also, I’m on a hair trigger b/c watching acquaintances (DRONES) wander thru the day, defending an Enemy Combatant with ZERO FORMS OF ID spools my Mockery Dial to the red line.”

Even for a birther, that’s some bull moose looney.

There’s a rule in Birtherstan: Every claim increases in magnitude exponentially with each telling of the tale. Soon the entire sheriff’s office will have decamped to Honolulu for the duration.

I think that’s what is known as “acting out”. I see five year olds do it often, usually resulting in a tantrum. Lots of those at BR. Usually comes when the realization hits that they are done.

In my experience most five year old children act better….even at their worst.

  25. Bob says:

Reading Birther Report is like watching a headless chicken run around a barnyard except that it thinks it’s head will be re-attached any day now.

  26. RanTalbott says:

Arthur: Their threat-filled collective hysteria reminds me of descriptions of medieval dancing mania.

It reminds me of descriptions of Klan rallies and revolutionary cabal meetings: lots of saber-rattling, and graphic descriptions of how they intend to murder their enemies.

I’m worried about next month’s OAS gathering: some of those nuts are talking like suicide bombers seeking martyrdom. If they get more than the usual pitiful turnout, their “monitors” may not be able to weed out all the armed loons, and one or more could try for a suicide-by-cop to “expose the tyranny”.

Has Volin ever addressed the reason why MCSO says that they are not involved in any birther investigation of Barack Obama’s Birth Certificate when someone calls there? I have called there and the front desk personnel emphatically deny that any birther investigation is going on. I sure would like to see Volin explain WHY that is.

  30. bgansel9 says:

Curious George: And this is all okay with Arpaio?

Quite honestly, I think he hasn’t really given much thought or care to the situation until the vehicles were found to have a lack of insurance and it certainly seems that he hasn’t done much to remedy the problem. Not the kind of person I would consider for a position as governor, that’s for sure.

  31. Bonsall Obot says:

    RanTalbott:

    There’s that word, “If.”

I always expect to hear about some Birfer finally snapping and killing innocent people, but I don’t think their little pity party will be a factor.

The birthers will absolutely freak out. They seem to think the Sheriff is the only legitimate person with the power to remove the president, as I have read. (Bwahaha!)

Volin won’t let that question through the screening room. Volin has never directly addressed the Xerox workflow, the Brian Reilly information nor that the MCSO says there is no investigation going on.

  36. MarylandCountryGirl says:

I see the liberals sweating already. Mike and his men must be getting awfully close to something to have so many people freaked out. Instead of worrying about Mike Zullo’s tax exempt status, maybe you should worry about the IRS giving bonuses to employees behind in their taxes, and those with conduct issues; To the tune of 3.8 million dollars.

Maybe you should invest this time in real issues, such as the violation of the Constitution by the government everyday.

Lastly, if you think this country’s problems are limited to just the democrats or republicans, then you haven’t been paying attention. Do us all a favor and keep your pure ignorance to yourself

  37. So where do you see evidence of anybody being freaked out? I don’t feel in the least “freaked out” and I certainly don’t feel any anxiety over a a complete incompetent in Arizona. So Mike Zullo evading the law is proof that he’s onto something? What’s next? Up is down? Hot is Cold? Good is evil?

Your comment about the IRS (article here) doesn’t affect the fact that the Cold Case Posse is skirting tax laws. Your diversion isn’t going to work, and not relevant to this blog. Is it evidence that the birthers are freaking out over the demise of their whole way of life?

MarylandCountryGirl: I see the liberals sweating already. Mike and his men must be getting awfully close to something to have so many people freaked out.

    … IRS Bonuses …

MarylandCountryGirl: I see the liberals sweating already. Mike and his men must be getting awfully close

    Yes, any day now, remember?

We’ve actually been sweating since 2011 at least. I, for one, only survive because Our Beloved Alien Overlords kindly suspended me in some W’raaxxnian cooling liquid back when Orly said she’d have Obama out of office in 30 daze, uh, days.

MarylandCountryGirl: Maybe you should invest this time in real issues

You’re trying to divert our attention away from the shenanigans of the Cold Case Puppies? Hm, I see you sweating already, we must be getting awfully close to something to have you worry about this lowly blog and a handful of Obots looking where there’s nothing to find, huh? 😉

  40. The Magic M says:

Bonsall Obot: I always expect to hear about some Birfer finally snapping and killing innocent people

I don’t (anymore). The snapping kind are those that still try to actually do something, not just sit foaming behind their keyboards. Heck, even the craziest KKK people occasionally don their hood and burn a cross. Birthers don’t do *anything* except posting on birther sites. I’d be surprised they could load a gun without shooting themselves in the foot or worse. And they’re too coward to try and attack anyone with a knife.

  41. American Mzungu says:

What MarylandCountryGirl calls Doc’s pure ignorance is highly valued information for most of us. I can understand that birthers don’t want this information presented and discussed. Doc, please continue to perform the valuable public service of shining light on the multiple problems of the Cold Case Posse.

  42. Thinker says:

I second Dr. Conspiracy’s question. What do you see here that leads you to believe people here are sweating and freaked out?

  43. Bovril says:

    So,

Assuming the CountryGirl is actually looking at responses, do tell.

Exactly which “violation of the Constitution” are you talking about..?

Exactly what is causing this “liberals sweating” ..?

I mean surely you don’t mean Birthers, Birthing and L’il Mikey Zullo, the only responses they trigger are mirth, laughter and schadenfreude.

They and by extension you are sad, silly, ineffectual dullards with the intellectual capacity of a brain damaged sloth and a total lack of success in all of their eneavours.

  44. Bonsall Obot says:

All that being valid, we still have people like Wally Fitzpatrick, Holy Cao, and he, LDS, all criminals, all with poor impulse control; I can easily envision one of them, or someone like them, completely losing her or his shpadoinkle and lashing out violently. I’m not talking about the Keyboard Kommando Korps, like bird boy, who are all cowards; I’m talking about the mentally unbalanced ones the Korps is deliberately trying to provoke.

For any of the birther faithful, including MarylandCountryGirl, who are having a difficult time comprehending this thread, I offer for your consideration, Cold Case Posse, 101. This is offered as a Pass / Fail course for those who have been infected with chronic “birther nonsense disease.”

Mr. Zullo is not a real cop. He is an unpaid volunteer. He has no powers of arrest. His Cold Case Posse is a not a law enforcement agency, but it is a public, non-profit charity 501(c) 3 corporation. His stand alone Cold Case Posse is a separate entity, not connected to the Maricopa County Sheriff’s Office. The Cold Case Posse is a support to law enforcement at Arpaio’s request.

Exam questions: (Remember, this is P/F)

    1. Is Michael Zullo a real cop? (No)

    2. Is the Cold Case Posse a real law enforcement agency? (No)

    3. Are donations to Mr. Zullo’s Cold Case Posse, tax deductible? (Yes)

    4. Are non-profit corporations required to follow the laws of the state? (Yes)

    5. Is the Cold Case Posse part of the United States Post Office? (No)

    Extra point question:

Does Mr. Zullo have the power of arrest? (No)

Next course: How to cope with birther shock, 102

Speculation that Sheriff Arpaio could end up in jail:
    http://www.phoenixnewtimes.com/2014-04-24/news/joe-arpaio-racial-profiling/

Arpaio is a past master at pushing things to the edge of the cliff.

The real question is how far Judge Snow will let him go before he moves to cite him for contempt. While I love the idea of Arpaio in his own jail I suspect he would scramble back from the precipice if he was really facing a pair of pink undershorts.

Again, examples? And the next time that blind squirrel finds a nut will be the first. His perfect record of FAIL remains intact.

    MarylandCountryGirl:

Instead of worrying about Mike Zullo’s tax exempt status, maybe you should worry about the IRS giving bonuses to employees behind in their taxes, and those with conduct issues; To the tune of 3.8 million dollars.

Citation needed. And your concern with how others spend their time would be touching, if it weren’t so wildly off-topic and disingenuous.

    MarylandCountryGirl:

Maybe you should invest this time in real issues, such as the violation of the Constitution by the government everyday.

Again, citation needed and, again, your concern for how others spend their time is duly noted. But I find it odd that all your suggestions involve looking at someone, anyone, besides Birfers. Curious, that.

    MarylandCountryGirl:

Lastly, if you think this country’s problems are limited to just the democrats or republicans, then you haven’t been paying attention.

This is a response to a statement no one here made; perhaps a voice in your head?

  71. CarlOrcas says:

Jim: Federal Court, Federal Prison (I think).Pink underwear optional.

A couple thoughts: First, it would be civil contempt and involve only a fine and/or a day or two in jail. There is a medium security federal prison just north of Phoenix but prisoners only go there after being sentenced and turned over the Bureau of Prisons.

People arrested by federal officers are already booked into the Maricopa County Jail where they’re used to handling short term prisoners and prisoners who need to make court appearances.

All that said…..if Arpaio were to be cited I suspect Judge Snow would make arrangements for him to be held somewhere away from the general population but in a real jail/prison.

There is a state prison facility near downtown…..on the grounds of the state mental hospital…..that might work.

Here are some comments about Bundy under the latest article at B.R.

negro college fund: bundy is not a racist.

EWO, @negro college fund: I agree. He’s just misunderstood. He himself said that he doesn’t have the vocabulary to express himself correctly. The left wing vultures took this opportunity to demonize him.

kittycat: The libs are always twisting what people say.

EWO: It’s the hateful race baiting left that’s trying to demonize Bundy. It’s hateful sheeple pea brains that choose to believe them.

George: No way what Bundy said was racist. The libs are quick to jump on it and twist it around but really what he should have done was use the word DEMOCRATS instead of NEGROS and that is the gist of who he was talking about.

Barack_D_Fraud: if you look at black’s relative position in society today vs when they were slaves, bundy is right. when they were slaves they had self respect for theselves, today for the most part they dont. for every alan keyes there are 100000 snoop dogs

Are birthers racist? Do you really have to ask.

You’ll find the same and worse at Breitbart. Everything from “he’s just exercising his 1st amendment rights” over “he’s just telling it like it is” to “the n***s are the real racists for allowing Communists to enslave them”.

I think birthers are pretty harmless in comparison, they’re mostly obsessed with feces and buttsecks, idiots to laugh at, but the Tea Party crowd is just abhorrent. The latter are the ones who did the lynchings, the birthers would “only” have cheered.

“Considering that Brian Reilly and Kevin Davidson are trying to get the names and home addresses of everyone on the CCP for who knows what sinister purposes, potentially putting their homes and families at risk, I sincerely doubt that the CCP is delaying things just to cause you frustration.”

As it has already been pointed out on another site, Reilly would know the other members and their addresses. As far as “sinister purposes,” this is called a diversion. The real issues at hand are financial accountability, transparency, and the CCCP following the laws of the state of Arizona. I detect a connection between “Cassandra” and “Joe Mannix.” They have become the Birther Recycle spinmeisters for the apparent Cold Case Posse money making enterprise. By the way, has the NSA tripped over the CCCP desk in the post office parking lot….yet? And, is it on wheels for a quick getaway?

  83. I have all the names on the corporate registration, and I have all the redacted addresses on the IRS form featured in the article. I didn’t publish them because it’s against policy. I haven’t looked at them because I’m not interested.

  85. Notorial Dissent says:

I think it might be about time that someone gave a heads up to the AZ Corp Commission, that Zullo is using invalid, dare I say fraudulent, addresses on his CCP registration, which is a violation of state law, and they must have a “real” street address for the registered agent at all times, seems they are not complying with state regs there.

And, if someone were feeling really cranky, they might let the state tax office know that CCP is not registered correctly for tax status, it is claiming to be a part of MCSO, when it plainly isn’t, and has been repudiated as being, and so is again committing another registration fraud, since as a regular non profit it has to meet certain reporting and registration rules that don’t apply to gov’t auxiliaries.

  91. Andrew Vrba, PmG says:

Oh I do so hope a discussion about this breaks out at BR.

  92. Rickey says:

My Freedom of Information request to the Demarest Police Department was not as fruitful as I hoped, but it does confirm that Zullo was a small-town police officer. This is their response:

“Mr. Zullo was a Demarest Police Officer prior to the appointment of the undersigned and all current Demarest Police Officers. The undersigned has no access to any records during the time frame of Mr. Zullo’s employment as a Demarest Police Officer. I believe that Mr. Zullo and his family relocated to Arizona prior to my appointment to the Demarest Police Department.”

My first reaction was that the officer who responded was saying that the records have been destroyed, but on second thought it may be that the Police Department doesn’t keep records of former officers but the Borough of Demarest does. Since the letter is already written I’m going to resubmit it to the Borough of Demarest and see if I can get more information.

As we know, the current Police Department consists of a chief, a deputy chief, two sergeants, nine patrolmen and five “special police.” The “special police” do such things as crowd control, directing traffic, etc. There are no detectives on the force. The population of Demarest has been stagnant for the past 25 years so it’s likely that the composition of the police force has not changed much since Zullo was there.

One thing I have learned in my business if the value of persistence.

I don’t know whether someone else has already thought of this one, but I thought it made an especially apt clue-by-four whack for one of the “Arpaio will save us any day now” crowd, and might be reusable:

After TWO-AND-A-HALF YEARS, Arpaio hasn’t even been able to name a specific crime, and get his county attorney or AG to open a case file.

Instead of _solving_ cold cases, the CCP have actually _created_ one.
