Despite dubious claims of being “law enforcement,” the Maricopa County Sheriff’s Cold Case Posse doesn’t act like law enforcement, but more like someone trying to evade the law.
Case in point is their obligation under federal law to provide certain information regarding their IRS tax-exempt status. When I asked for the legally required information in a registered letter, they refused delivery (didn’t sign for the letter at their PO Box) and when they finally responded to someone else, they redacted parts of the filing, not complying fully with the law. Here are some of the redactions:
At least two complaints have been filed with the IRS regarding the CCP tax exempt status, one documenting that their primary activity is political, and one filed by me that their independent status conflicts with their exemption from filing financial disclosure forms.
A second matter is the recent discovery that those county government “G” license plates on Posse cars are not registered to the county, but to the Posse itself. Irregularities with the Posse and it’s vehicles have been referred to the state auditor.
Now a third complaint has been filed with the Arizona Corporation Commission. The full story appears in an April 22 article at Arizona’s Politics. The complaint was filed by former Posse member Brian Reilly, well-known to readers of this blog. Reilly alleges that filings with the Corporation Commission were altered around the time the Posse went into the Evil Obama business (my phrase) to obscure the current addresses of those who run the Posse.
Arizona law requires the street address be provided for a corporate address, and the 2011 filing does contain a street address of sorts (and the same address is listed for all corporate officers and directors).
Here’s what is located at that street address:
It’s the Daisy Mountain post office at 44047 N 43rd Ave.
The only real address on the form is the “physical address” of Mike Zullo, in his capacity as registered agent, and that address belongs to the Sheriff’s Office, where Zullo has box where he can pick up mail without signing for it. It appears that this exercise in obstruction might be to prevent delivery of registered mail to him, or maybe Zullo is acting paranoid.
Dear Mr Zullo, since we know you read here and keep up with us…you might want to consider a little piece of advice. You might wish to close up the CCP shop and end the sham investigation pretty soon. All these little nuisances in and of themselves may seem to be just a bump in the road now, but they are starting to add up to something you really don’t want. Pretty soon the IRS is going to want to see your personal finances, as well as all the records from the CCP to make sure you have been using donations as they were meant and not for personal use. You want to see a REAL investigation at work, it will be against you…and it won’t be pretty. Very simply, if you close it down now, you’ll probably be able to skate by. If you keep on going till the mid-terms, you’re probably going to find yourself in really deep doo-doo. Your choice, because you know by now your sham investigation is NOT going to get the President. Just my 2 cents for you.

Between all this negative press the CCP is getting as of late, and LDS’s little house of lies crumbling, I forsee a huge increase in puff pieces and “We’re SO close!” damage control articles at BR, in the immediate future.
Ending the sham is good advise for Mr. Zullo. In the end, though, it won’t protect him and all the other officers and directors of the corporation from personal responsibility for the organization’s mismanagement and possible misdeeds since it was founded in 2007.
Until the posse reveals its finances reasonable people will wonder what is being hidden.
And if two or more are acting in concert to unlawfully hide these unlawful acts… well, there’s a word for that.

Mr. Zullo. Which part of the “Daisy Mountain” Post Office is used for your office space? Is it the lobby? Is it a reserved parking space where your desk sits? Do you have unmarked Post Office trucks with government plates? Do you have a Post Office gas key? Do you get free postage stamps for your birther solicitations? Have you redacted your government vehicle plates as well? And this is all okay with Arpaio?

I’m confident that neither the mid-term nor any other election will factor into any decision the IRS makes regarding the Cold Case Posse. Suggesting that it will is just feeding the wingnut fake outrage machine about the fake “IRS targeting teabaggers” scandal.
You’re reading too much into it, by keeping it going longer it seems that more and more things that they are doing wrong (and possibly illegally) will keep on popping up. Such as the cars, the lack of oversight, etc, etc, etc. If he shuts it down now, nobody will probably care enough to worry. If he keeps it going, who knows how many other misdeeds and illegal activities others might uncover and report about the CCP. The IRS does not care about elections, but Zullo might.
I find that the crazier Birther Report is, the more entertaining I find it. It’s like an adult “show and tell” assignment over there with all their pictures and the primary theme of every thread is name-calling/ad hominem attack.
They never have a serious discussion of issues and they act like frightened little children when it comes to debate.

People like Volin repeating and exaggerating Zullo claims is just making it worse for them. Yesterday on the KFAB Chris Baker show Volin claimed that the MCSO had people in Hawaii for months looking at records. He didn’t say the cold case posse but rather that the Sheriff’s office itself did this. If any of this were true then taxpayer resources would have been used illegally more than they already are.

Reading Birther Report is like watching a headless chicken run around a barnyard except that it thinks it’s head will be re-attached any day now.

I’m worried about next month’s OAS gathering: some of those nuts are talking like suicide bombers seeking martyrdom. Has Volin ever addressed the reason why MCSO says that they are not involved in any birther investigation of Barack Obama’s Birth Certificate when someone calls there? I have called there and the front desk personnel emphatically deny that any birther investigation is going on. I sure would like to see Volin explain WHY that is.

A couple thoughts: First, it would be civil contempt and involve only a fine and/or a day or two in jail. There is a medium security federal prison just north of Phoenix but prisoners only go there after being sentenced and turned over the Bureau of Prisons.
People arrested by federal officers are already booked into the Maricopa County Jail where they’re used to handling short term prisoners and prisoners who need to make court appearances.
All that said…..if Arpaio were to be cited I suspect Judge Snow would make arrangements for him to be held somewhere away from the general population but in a real jail/prison.
There is a state prison facility near downtown…..on the grounds of the state mental hospital…..that might work.

I have all the names on the corporate registration, and I have all the redacted addresses on the IRS form featured in the article. I didn’t publish them because it’s against policy. I haven’t looked at them because I’m not interested.

I think it might be about time that someone gave a heads up to the AZ Corp Commission, that Zullo is using invalid, dare I say fraudulent, addresses on his CCP registration, which is a violation of state law, and they must have a “real” street address for the registered agent at all times, seems they are not complying with state regs there.
And, if someone were feeling really cranky, they might let the state tax office know that CCP is not registered correctly for tax status, it is claiming to be a part of MCSO, when it plainly isn’t, and has been repudiated as being, and so is again committing another registration fraud, since as a regular non profit it has to meet certain reporting and registration rules that don’t apply to gov’t auxiliaries.

My Freedom of Information request to the Demarest Police Department was not as fruitful as I hoped, but it does confirm that Zullo was a small-town police officer. This is their response:
“Mr. Zullo was a Demarest Police Officer prior to the appointment of the undersigned and all current Demarest Police Officers. The undersigned has no access to any records during the time frame of Mr. Zullo’s employment as a Demarest Police Officer. I believe that Mr. Zullo and his family relocated to Arizona prior to my appointment to the Demarest Police Department.”
My first reaction was that the officer who responded was saying that the records have been destroyed, but on second thought it may be that the Police Department doesn’t keep records of former officers but the Borough of Demarest does. Since the letter is already written I’m going to resubmit it to the Borough of Demarest and see if I can get more information.
As we know, the current Police Department consists of a chief, a deputy chief, two sergeants, nine patrolmen and five “special police.” The “special police” do such things as crowd control, directing traffic, etc. There are no detectives on the force. The population of Demarest has been stagnant for the past 25 years so it’s likely that the composition of the police force has not changed much since Zullo was there.
One thing I have learned in my business if the value of persistence.
