Strunk v State

Christopher Earl Strunk sued the United States Department of State and the Department of Homeland Security over documents he requested under the Freedom of Information Act (FOIA), documents about Barack Obama and his mother, Stanley Ann Dunham. After a lengthy delay, the Department of State turned over 6 documents. There are references to a 1965 Passport application for Stanley Ann Soetoro (her married name), but the Department of State said that the application itself could not be found and was likely destroyed as part of a purge of non-essential records including routine passport applications done in the 1980s. Documents relating to Barack Obama himself are not available under FOIA because he is a living US person.

Strunk alleged that the 1965 Passport Application (and possibly earlier documents) were probably not destroyed, based on arguments that did not impress the court, who cited:

Such affidavits and declarations [from the government] are “accorded a presumption of good faith, which cannot be rebutted by ‘purely’ speculative claims about the existence or discoverability of other documents.”

The court dismissed the suit on March 10, 2011 in regards to the Department of State defendant.

I have my own FOIA request, similar to Strunk’s, which is presently under administrative appeal. Strunk asked for passport applications, but I asked for passports issued and I have reason to believe that additional records exist of that type.
