Taitz files incoherent lawsuit

Orly Taitz filed another lawsuit on July 5 in the US District Court for the Central District of California, Taitz v. Sebelius (8:2012cv01092). The tricky part is figuring what the suit is about. It appears that Taitz has taken all of her old lawsuits and added them to new lawsuit, creating a confusing mashup of everything from the Affordable Healthcare Act to a RICO complaint against Hawaii vital records director Alvin Onaka.

The new part of the case is an equal protection claim that the Affordable Healthcare Act discriminates against Christians and Jews to the benefits of Muslims, which Taitz claims are exempt from the mandatory insurance coverage provision of the Act. That in itself is a dubious claim. The ACA does provide a religious exemption for persons whose religions prohibit insurance. The same is true for Medicare. Muslims, however, are not exempted from Medicare and so it makes little sense to assume that they would be exempted from the ACA. It would be more plausible to say the law favors the Amish, but Taitz doesn’t appear to be prejudiced against the Amish. Snopes has an article with more details.

At least that part I understand. But how does Sheriff Arpaio fit in? And how about the rest of these defendants:

What is curious is that Taitz has filed the case as a private citizen rather than as an attorney, yet she seeks to have Christians and Jews certified as a class.

The unifying theme in the suit is, of course Obama. Taitz’ Quixotic quest to remove Barack Obama includes anything and everything she believes negative to him. So in her mind allegations of Selective Service forgery are valid objections to the Affordable Healthcare Act.

The 113-page complaint contains many attachments of the usual Taitz material: Arpaio’s Affidavit, Obama’s Indonesian school registration, Obama’s certificate of nomination from the Hawaii Democratic Party, Paul Irey examination of the long form and many more (for a total of 17). The only link I have to the case right now is at the Taitz web site.

    That’s right! Orly Taitz has lost her license to practice dentistry in California and if currently treating patients today, – she’s practicing without a license! But in fairness to Orly, allowing for her difficulties with the English language, an excuse for her failure to comply with the California dental license-renewing fingerprints requirement may be powerfully confirmed by DNA evidence still encrusted on one of her office’s reclining dental chairs, reminding us of that touching moment when Orly was convinced that her finger prince was Charles Lincoln the 3rd!

    I think she’s allowed to practice until the end of August, when her current license expires. They denied her renewal.

    When she spoke at the Georgia ballot challenge I was struck by the fact that, when given all the time in the world, she couldn’t even state her case coherently and it had nothing to do with English not being her native language. It’s her whole life yet she can’t even explain why she thinks Obama isn’t eligible. She doesn’t finish one thought before going on to two other non-related topics. You would think she could memorize a 15 minute spiel to simply state her case but she just can’t do it.

    Everything she says or writes outside of a courtroom is cleaned up for her by allies and by Birther watchers — “I guess she means . . .” and she has benefitted from that but, thankfully, that gets her nowhere with judges.

    As I think was noted on the open thread, Taitz has moved for the judge to recuse herself in this case. The argument is that the judge was appointed by Obama, and one of several unrelated arguments in this lawsuit is that Obama is ineligible, and that would, in the birther fantasy world, imply that the judge’s appointment would be void, so the judge has a conflict of interest on this case.

    I wonder if the judge will find this argument funny or just annoying.

    I meandered over to her site today, and she says it’s all lies and the licensing entity will be receiving her fingerprints before August 31. I think she doesn’t understand the word PROCEDURE very well. Won’t she be surprised when she finds out her license really isn’t being renewed?

    It is not just that Dr. Taitz has asked the Judge to recuse herself, but she has also asked that the case be transferred to Orange County Federal Court. If I understand how federal courts work, that is where Judge Carter is located. Is Dr. Taitz really that nuts that she wants to go to Judge Carter?

    Sadly, misha, there were a significant number of Jews in Italy under Mussolini who joined the Fascist Party. Some remained in it until as late as 1938, when he expelled them under rascist laws passed after the Axis agreements with the Nazis.

    Misha, may I ask what you are suggesting? Mormons come a dime a dozen here. The Phoenix metro area is literally filled with Mormons (they practically own Mesa, AZ). What could Bennett/Romney’s Mormonism do to AZ specifically?

    Does anybody know if Taitz actually does any dentistry? It would seem that with all the time taken up writing legal guff, website guff, and generally engaging in narcissistic self-promotion, she wouldn’t have a lot of hours to get down to the serious business of working on human dentition…
