Je recuse!

I am not a lawyer, so when I see some novel phrase from Orly Taitz, I may not know whether it makes sense or not. I remember when she accused the President of “uttering,” which was the right word for what she was trying to say, even though it wasn’t true.

The Orly Law legal term du jour following last week’s “ex parte,” is “recuse.” Here’s a sample from Orly’s latest filing in Grinols v. Electoral College:

Plaintiffs also moved to recuse the Department of Justice/US Attorney’s office from the representation of Barack Soebarkah, aka Soetoro, aka Obama…

Bryan A. Garner, author of A Dictionary of Modern Legal Usage and editor in chief of the Oxford Law Dictionary Project said:

Disqualify might be used in place of recuse, but the reverse does not hold. Disqualify, the broader term, may be used of witnesses, for example, as well of judges, whereas recuse is applied only to someone who sits in judgment, usually judges or jurors.

… but not in Orly Law. Taitz has moved that the court recuse the US Attorney from representing federal defendants in Grinols.

Specifically, Taitz has moved that the US Attorney be “recused” from representing the Electoral College. Given that there is no Electoral College right now, and that it is not an entity that can be sued, that doesn’t mean a lot. Second, she wants the US Attorney “recused” from representing Joe Biden, the President of the Senate. That’s OK, because Joe Biden isn’t a party to the case. Taitz wants the US Attorney “recused” from representing President Obama, and that’s not an issue either because apparently, until he is served with the complaint, President Obama isn’t a party to the suit either. The issue is with Congress, where the US Attorney has responded.

In this latter matter, Taitz is claiming that the the Congress is properly represented by the Office of the General Counsel of the House of Representatives, who has responded to Taitz that the House members whom Orly Taitz tried to contact directly will not answer her sham subpoenas.

I think it is a defining characteristic of legal crackpots that they attack not only the issue at hand, but opposing counsel and the judge. Here Orly is trying to disqualify the US Attorney (and to be fair Taitz uses this word too in the page footer) in order to negate the motion to dismiss that is looming to derail her entire judicial circus. This provides a good example of what happens when a Taitz case is allowed to fester: multiplicity of filings and endless complexity of proceedings. The docket has passed 100 entries in Grinols.

Here we arrive at a central principle of Orly Law, which is “whatever benefits Orly is Law.” A corollary is that “one can have ones cake and eat it too if one is Orly Taitz.” Case in point: Orly served the complaint against all of these federal entities on the Department of Justice, arguing that the complaint is valid and properly served, while at the same time arguing that the agency she served cannot represent the federal defendants she is suing.

    I wonder if Judge England and his staff, or maybe the defendants’ attorneys, have grounds to sue the California State Bar for unleashing on them this pestilence known as Orly Taitz, aka Obly Taitz, aka Lena, aka Orly T.     Orly is a textbook example of a vexatious litigant. While we already know that the alleged California Bar Association is hopeless, why the courts keep giving her a pass is one of the great mysteries of the universe.

    Orly apparently doesn’t realize that the Congress includes both the House of Representatives and the Senate. I doubt that the Office of the General Counsel of the House of Representatives has any duty or authority to represent the Senate.

    Does she sit up night concocting these crazy theories? Her clients would be better served if they were represented by The Three Stooges.

    the people who recused themselves are respected attorneys (on the right) who could have certainly entered this fight nearly 6 years ago had there been any merit to or questions about obama’s eligibility

    i can’t conceive on any elementary school civics classes, while discussing the qualifications of the presidency, adding a 3rd class of citizenship exclusively for the presidency

    Her screw-up is even better. She served Congress through the US Attorney, and he made it very clear that he was getting involved as a courtesy, and to represent the interests of the United States. The General Counsel for Congress responded because of subpoenas served on members of Congress. That makes sense because the US Attorney’s remit can’t extend to individual members. But there could still be a role for both of them in this litigation. More to the point, Orly doesn’t get to choose.

    She complains that Judge England demeaned her, a term that in fact she cribbed from one of her followers, who used it when another judge smacked her down a few months ago.

    On the issue of ex parte motions, she misunderstands what Judge England was saying, which was that you can’t generally use them in the course of litigation that has commenced and is contested. From there, she segues into some utter nonse about her 14th. Amendment rights being violated. If she read/understood the Constitution, she’d know that this is all about legislation, not how a judge treats her delusional paperwork.

    I could go on…I hope that Taft Law School loses its accreditation, that the BA Bar introduces proper exams and procedures, and that Judge England demolishes her very soon.

    I got you beat. Back in the 6th grade, we had a Law Professor visit our school and we had 2 girls whose parents were from India. The Father was a visiting Professor at the UofI. The Law Professor explained to us why the older girl would be eligible (born in the US while they were here as students) while the younger daughter would not (born in India). Makes it a heck of a lot simpler than having your complete family citizenship history being required on your BC to establish if you were natural born or not.

    It’s hilarious that she submitted to the court that letter from the General Counsel of the House of Representatives presenting the reasons why her subpoenas are ridiculously flawed, just in case Judge England had not noticed all the deficiencies himself. The letter also refers to the House members who received her subpoenas as third parties. Oops.

In truth describing Orly this way is an offense to the village idiot. Or better still how about that cartoon sequence where the animated character is sitting on a branch and then decides to saw that very branch as a means of getting down, completely oblivious of the fact…! Those cartoons were great entertainment but Orly tops them all b’coz she is real and even funnier

    If, in theory the tri-partite system represents the judge (judicial branch), jury (House of Reps and Senate), and executioner (or administrator of punishment) via commander-in-chief, military and law enforcement, then of course she is going to attack all three branches, seeing as she is conviced that she is the judge, jury and executioner.

    She has a dangerous mind- not mere mental illness but manifestations of criminal insanity. She only wishes she could eliminate a valid criminal case against the President so she can bring it down to the personal attack it is.

    if she gets the same ammount of supporters at a congressional meeting as she did at her last two historic protests, i don’t think they’ll have much impact.

    She hires hacks to do the dentistry & probably does a few cases herself during the time she is sane. Judging by the pic on her website…it shows her in a white coat positioned near a dental chair in what looks like a consultation before she begins the real torture. If they screw up your case forget about suing boz she would likely sue you first for coming to her as a dental patient. You should the yelp reviews about her dentistry office. One describes the front office treatment as rude & some others concur plus add add the office looks dirty like in unsanitary.

    I was trying to figure out why she labels herself as “Orly Taitz, DDS, JD” on her site. After all, I doubt many people seeking quality dental care make sure their prospective dentist is also an attorney before making an appointment. So it is either simply her ego at work (but if that were all, then why didn’t she also mention her real estate license?) or a means of saying “Don’t even think about suing me after I ruin your teeth.” Why do I have a feeling that she’s the fifth dentist dentist, the one who recommends that her patients chew gum with sugar?

    On February 28, 1968, seeing his cause was hopeless, Romney announced his withdrawal as a presidential candidate

    Questions were occasionally asked about Romney’s eligibility to run for President owing to his birth in Mexico, given the ambiguity in the United States Constitution over the phrase “natural-born citizen”. (Romney departed the race before the matter could be more definitively resolved, although the preponderance of opinion then and since has been that he was eligible.

    Alexander’s mother claimed she conceived him by a serpent. Zeus, according to this source and others, is described as a serpent. Alexander believed it all true. Since I study mythology from time to time, I found Hercules in relation to Alexander somewhere in my studies, but can’t find it to post just now. My only point is that religious controversies in Europe caused founding fathers to, in my opinion, stick with natural law rather than supernatural law.

    I’m honestly surprised that there aren’t more negative reviews considering the number of malpractice cases brought against her as a dentist. It’s the only reason she ever became an attorney. She didn’t want to pay the high legal costs associated with being a dentist or attempt to improve her dentistry skills, so she went to law school to handle her own malpractice cases. This explains why she’s such a crappy attorney. It was only a means to save her money, not necessarily something she was going to use in the future. It doesn’t explain, however, her managing to pass the CA Bar Exam. That still seems very suspicious considering her lack of legal knowledge.

    I can assure you that no one with a four year diploma was allowed to practise dentistry on their own in the Soviet Union. You needed to do a two years’ internship at a hospital or sanatorium first. Israel at one time did have a shortage of dentists. Same thing for doctors.

    Of course, at her Kishinev school (before the age of 17) Orly was taught Moldavian as a secondary language. Some people would claim Moldavian in those days was just Romanian spelled in cyrillic letters. Meaning that for Orly, following a course in Romania to supplement her Soviet certificate would not have been difficult.
