“But Frum goes even further than that in his post ‘Were Our Enemies Right?’ Frum suggests that the entire conservative movement has fundamentally misunderstood how to manage the economy, and he compares it to how the ‘left’ failed to understand the true nature of Soviet Communism.”

    Recycled birther meme.

On his blogtalk show yesterday MIke Volin brought up the 2007 Selma, Alabama speech by then-Senator Obama.

He is convinced that it is an admission that the President was born in Selma after 1965. What a moron.

There is also an update by Carl Gallups – basically nothing knew but they have not been able to get together with Congressman Stockman again and Gallups mentions several times that Stockman could drop out and that maybe nothing will happen before the President leaves office in 2017.

  10. Stephen says:

Perhaps someone can clarify for me (in small words) the significance of the discussion regarding whether there are anomalies with the scan of the document purported to be the Official Birth Certificate of President Obama and whether any such anomalies are significant.

As I understand it, the State of Hawaii issued a paper document to the President. That paper document was his Birth Certificate. It is prima facie evidence of the information on it. The State of Hawaii has confirmed that they issued such a document, that it was based upon the information they held, and that the information on the scan is the same as the information on the document they issued.

So what is the significance of a purported copy/scan of that document? It is not an official anything. No court would consider it as evidence. If someone thinks that copy/scan has problems, so what?

Let’s assume that the document was retyped, cut and pasted, or whatever is being purported. So what? The underlying document has been vouched for by the State. Example, let’s say I apply for a job and need to prove that I am licensed to drive. I send a scan of my license to them. They question it and we ask the state – did you issue this guy a drivers’ license, is the information on the scan match the information you have on your copy of the license, and is the picture the same? And the state says yes to all this. The name matches, the address matches, the physical description matches (OK, the weight may be a little off but it’s the same as the state thinks), the picture matches, and there is a valid license that has been issued. Again, what’s the issue?

Stephen, you are preaching to the choir. Better ask Dr. Taitz Esq. But I suspect that she doesn’t have an answer to your questions as well ….

  13. Slartibartfast says:

I’m sorry Stephen, but your comment proves beyond a shadow of a doubt that you are nowhere near stupid enough to be a birther. You’ll never understand birther reasoning by taking an approach based on facts, logic, and the law.

Here’s my take on how someone arrives at the conclusion that the pdf image of the LFBC is in any way significant:

First, one has to fancy themselves a scientist while completely failing to understand how the scientific process works. In other words, to use a phrase coined by Richard Feynman, to engage in cargo cult science (aping the superficial trappings while being completely ignorant of the foundation on which they are based).

Instead of asking a scientific (i.e. falsifiable) question and employing a sound investigatory methodology to develop evidence to support or refute that question, you first need to determine the conclusion that you wish to reach (something like “the pdf posted to the White House website is a forgery” or “President* Obama was not born in Hawai’i”). A logical consequence of your conclusion should be that the LFBC pdf is a forgery—you are now ready to collect “evidence” to “prove” this to be the case, a process that is easy provided that you avoid any shred of objectivity.

The next step is to open up the pdf in a viewer which enables you to view the construction of the document (layers, metadata, etc.) and repeat the following process until you are satisfied that your “evidence” is “irrefudiatable”:

    1. Identify an aspect of the construction which you cannot explain (WARNING: any knowledge of image compression or pdf construction techniques will severely handicap you at this point).

    2. ??????

3, Classify the artifact as an anomaly which could only be the result of human intervention.

The beauty of this technique is that, having no discernable methodology, your methodology cannot be attacked.

If you truly wish to understand birther reasoning, however, you will most likely need to take proactive steps to adjust your intelligence level in order to be successful. A serious meth habit, hardcore huffing, and traumatic brain injury would all give you a good start in this quest.

    Hope this helped…

    * Using the title of president when referring to Mr. Obama is a dead giveaway that you are an evil socio-commie liberal obot of course—be sure to avoid rookie mistakes like this.

Stephen: Perhaps someone can clarify for me (in small words) the significance of the discussion regarding whether there are anomalies with the scan of the document purported to be the Official Birth Certificate of President Obama and whether any such anomalies are significant.

Arthur: If you’re a skeptic of “alternative medicine” and new-agey, anti-science baloney, you’ll enjoy this poetic, animated rant about a Englishman’s encounter with a young woman at a dinner party.

Tim Minchin is AUSTRALIAN. (born in UK to Australian parents, raised in Perth WA)

    And he is a GENIUS.

    And he is extremely funny.

And I have seen him live once, before he was ‘somebody’. I have regrettably missed him the last few times I had a chance.

  15. Rickey says:

There was supposed to be a “million Muslim” march and a “million biker” march in D.C. today. Apparently the two rallies drew a few hundred people.

    http://www.usnews.com/news/articles/2013/09/11/2-million-bikers-christian-activists-confront-911-gathering-formerly-called-the-million-muslim-march

  16. Arthur says:

    Keith: Tim Minchin is AUSTRALIAN.

Yes, you’re right. I was confused because he sets the encounter in England. Sorry ’bout that.

  17. The birther theory is that the White House PDF file of the President’s long-form birth certificate is a fake because it shows indications of being assembled by a human using bits of other certificates rather than being a scan of a single original document.

If it’s not a scan of an original document, then the President lied about what was released to the public. If he lied about this, then he must be covering up something, which is obviously that he doesn’t have a real Hawaiian birth certificate to scan.

There are two essential problems with the theory:

    1) The PDF file does not show indications that a human assembled it from pieces of other certificates, but rather shows that it was scanned from an original document by an office machine like the Xerox WorkCentre 7655 and then rotated with Mac Preview.

    2) The fact that Obama has an authentic Hawaiian birth certificate has been verified, independent of what the White House released.

If you are expecting to find any sense in the birther conclusions, or any coherent alternative narrative explaining the evidence regarding Obama’s birth place, you are wasting your time. The birther theory is not logically coherent–it does not make sense.

Stephen: So what is the significance of a purported copy/scan of that document? It is not an official anything. No court would consider it as evidence. If someone thinks that copy/scan has problems, so what?

  18. RanTalbott says:

The European: Again, what’s the issue?

The issue is that there are a bunch of people who literally hate Obama, for a variety of reasons: some because he’s black, some because he’s liberal, some because they don’t understand the real world and expect whoever’s President to work various kinds of miracles.

There’s a smaller group of people who make money exploiting that hate. And some of them came up with a scam to give the racists and other “socially unacceptable” haters some cover by pretending there’s something fishy about his paperwork. They concocted phony “issues”, and the haters get say “See? I’m not a racist: I hate him because he’s a crook”.

  19. The Catholic Church has been moving slowly in this direction for a long time. The Catechism of the Catholic Church (1994) said:

847 … Those who, through no fault of their own do not know the Gospel of Christ or his Church, but who nevertheless seek God with a sincere heart, and, moved by grace, try in their actions to do his will as they know it through the dictates of their conscience–those too may achieve eternal salvation.

This is a step in the liberalization of Catholic theology that appears to continue under the new Pope.

I found this thread on free republic atguing about the (French) dual citizenship of James Madison et al.

    http://www.freerepublic.com/focus/news/3054477/replies?c=473

I can’t post/reply there, but I have to say that the quoted book excerpt which claims that Madison et al would have had to appear before a French Court and swear allegiance in order to become “real” French citizens is extremely debatable (to say the least).

Once Honorary Citizenship was granted by the Assembly, if accepted (and certainly Madison did accept it), nothing more was required.

Same with US Homorary Citizenship granted by an Act of Congress, in fact.

There is room to debate what exactly that Honorary Citizen entailed in terms of rights, privileges & obligations, but the person on free republic who denies it altogether or the author of the book he quotes is wrong.

The 2 allegiances at birth theory seems somewhat arbitrary. Obama isn’t a natural born citizen because his father was a British citizen? Well, what about countries that don’t allow dual citizenships? If his father was Indonesian, would he still have 2 allegiances? If his real father was secretly an American but his life was the same in every other way, would he be eligible? Seems kind of like the rules for cooties.

  73. Rickey says:

In other news, the Social Security Administration has responded to Orly’s Motion for Summary Judgment in Taitz v. Colvin. The SSA response boils down to these points:

    1. The SSA has no record of Harry Bounel aka Harrison Bounel.

    2. Information about the SSN which Orly believes was issued to Bounel cannot be released because it was assigned to an individual who is still living.

  81. Dave says:

There’s a thing I’d like to figure out about the response the SSA made to Taitz today. It refers to a Oct 15 2012 FOIA request, which was not requested by Taitz (was this Hendershot?) in which the request had only a name, gender, and SSN. And they say: “However, because the October 15, 2012 FOIA request only provided Mr. Bounel’s name and an SSN,any information provided to the requester about SSA’s search would result in validation of the SSN.”

I don’t get this. It seems one could say “We found no record with that name and that SSN.” Such a statement would not validate the SSN.

SSA refers to a couple zibits which probably explain this, but Taitz didn’t post them. Can anyone figure this out?

  82. CarlOrcas says:

Rickey: We should tell them that all of us have fled to Belize.

  83. It provides information about the SSN. It’s what I said at the start–by including Obama’s SSN they poisoned the well. If they had only identified Bounel, and the 1890 birth date they would have had no problems.

  84. Dave says:

I certainly agree that a better FOIA request would have been Bounel’s name and birth year. In fact, has anyone checked the Social Security Death Index? That used to be searchable on the web, but I think it’s still available behind a paywall at ancestry.com.

I have not seen the October 2012 FOIA request, but apparently it was filed by someone named Leslie Bishop, who somehow is connected to Al Hendershot. The wording of the SSA reponse suggests that Bishop requested a Numident Letter for Obama’s SSN. “The Numident letter is a computer printout of information that is taken from the original application for a Social Security card. It is an electronic record of the information that is on an individual’s original application for an SSN and any other successive applications for replacement cards.”

SSA could not release a Numident Letter for Obama’s SSN because he is alive.

“Plaintiff is correct that the two prior decisions on which the trial court relied, Judd v. State, No. 2011-350, 2012 WL 1305003 (Vt. Mar. 15, 2012) (unpub. mem.) and In re Judd, No. 2011-108, 2011 WL 4976600 (Vt. July 7, 2011) (unpub. mem.), both involved a claim that plaintiff had been improperly prevented from voting and running for President because of his status as a convicted felon, a different issue from the one asserted in this case. We take judicial notice, however, that plaintiff has unsuccessfully raised the identical claim concerning President Obama in numerous other jurisdictions. See, e.g., Grinols v. Electoral College, No. 2:12-cv-02997-MCE-DAD, 2013 WL 2294885 (E.D. Cal. Jan. 30, 2013); Judd v. Sec’y of W.Va., No.2:11-cv-00369, 2013 WL 368375 (S.D.W.Va. May 23, 2013); Judd v. Browning, 104 So. 3d 1085 (Fla. 2012); Judd v. State Bd. of Elections of N.C., 731 S.E.2d 430 (N.C. 2012). Plaintiff’s claim is therefore res judicata, and was properly dismissed.

Yes, let’s all make like John McAfee and high-tail it to Ambergris Caye!! LOL

Only, don’t, unless you want to spend your time hanging around with a bunch of Texans (not that there’s anything wrong with that!). Having spent a couple years living in Belize back in the late 80’s, I do recommend it, but IMHO it’s better as an adventure destination. Instead of sipping fancy rum drinks on Ambergris, check out the inland. If you’re a birder, you’ll love the bird sanctuary; the lagoons and creeks there are just teeming with flocks of exotic birds that congregate during the dry season, as well as howler monkeys, crocs, and jaguars. For the Indiana Jones wannabe, there are virtually untouched (read: unlooted) Maya sites to explore – at least there were when I was there. You can still have your rum drink, but it’ll likely be served in a green coconut, cut open with a machete, with the rum poured right into the coconut water. No little umbrella necessary.

A piece by Klayman published Monday in Renew America serves as a gold mine of conservative fringe fantasies.

Fair enough. I’m operating on the assumption that the SSN which Orly and her minions spread across the Internet is the one which Obama was assigned. Regardless, it was assigned to someone who is alive and the SSA cannot release any information about it.

You may recall that Orly argued (unsuccessfully, of course) that the Social Security information is fair game because Obama released his tax return without fully redacting his SSN. By that standard, we should be entitled to see Orly’s bank records because she has published her bank account number.

Actually, he’s trying to use his favorite Latin phrase in a different way and failing spectacularly again. It is, however, a nice example of fractal wrongness in the pursuit of cargo cult law, so it’s got that going for it…

Just for funsies, I point out some of his errors…

“The issue with Barack Obama’s two birth certificates is that neither provide any independent evidence to substantiate the place and time of birth indicated on either document.

Something which is true of everyone’s birth certificate…

Birth documents, even state certified birth documents, are simply prima facie evidence.

Which means, if one understands the meaning of the term prima facie, that the information they contain is to be taken as true in the absence of credible evidence to the contrary (note to David: that does not include evidence that is of “little to no probative value“).

Their evidentiary value is based on the number of other, independent, corroborative pieces evidence the document produces, i.e., the name of the hospital, the name of the delivery physician, the name of attending nurses, excreta, that can provide other, independent, substantiation of the certified information.*

This would be the exact opposite of what prima facie means…

    In very rare cases,

    i.e. pretty much every case

such documents for one reason or another may be totally devoid of any other, independent, substantiating information.

Which is why it is important that, by law, those things are necessary for a birth certificate to be considered valid.

Unfortunately, such is the case with Barack Obama.

    I think he meant “unsurprisingly”.

In such cases, in order to “PROVE” the information contained in the state certified birth document is correct, the information from the natal hospital must also be provided.

Actually, such records are sealed and it would take an order from a court (who was bound by the “Full Faith and Credit” clause to accept a certified copy of a birth certificate at face value) to get them. However, in President Obama’s case this isn’t a problem since Kapi’olani Hospital was kind enough to publish a letter from the president which refers to that hospital as his place of birth.

Unfortunately, to date, such information has not been forthcoming from Mr. Obama, and, thus, his presidential qualifications have not been “Proven” to have been met**.

There is sufficient evidence that every single court in the United States is Constitutionally obligated to accept the facts of President Obama’s birth as documented.

    ex animo

Roughly translated, this means “out of breath”

    davidfarrar

At least he managed to spell his name right.

    * Independent of HDOH records. Please note: the two newspaper birth announcements were taken directly from HDOH records and do not represent independent verification of HDOH issued birth certified.

They do, however, constitute proof that the record was filed in August of 1961. Which, when combined with Hawai’i support for the record, makes any theories about Social Security number fraud, Selective Service registration fraud, or talk about travel on non-US passports patently ludicrous. Not to mention that the HDoH records are sufficient to prove the facts of President Obama’s birth to any relevant standard.

**Barack Obama was not the only presidential candidate in the 2008 elections sued [falsely] in federal court over his natural born Citizenship credentials. He wasn’t even the first. Those dubious honors belong to John McCain.”

He has a website: Citizens Grand Jury. It has a Paypal button. If you click the “About Larry Klayman” tab you learn many interesting things, like this: “Larry has been credited as being the inspiration for the Tea Party movement.”

So Klayman is calling for a march on Washington. Yes, again. This time the date for millions to surround the White House is Nov. 19.

Edit: Oops, I see the part about the fake grand juries has already been noted above.

Arthur: I’m pretty sure that the Latin word for “heart” is “cor,” and “ex animo” would be something like, “from the consciousness.”

“From the heart” would be “ex corde”. “Anima” means “breath”, but also “soul” (not to be confused with animum, also meaning “soul”, “life” etc.), so “ex anima” means “from the soul”. I initially thought this is some fixed expression from Catholic liturgy, but it doesn’t seem to be very common. Probably some pseudo-Catholic way of saying “from the bottom of my heart”, “with the deep conviction this is the truth” as opposed to “deliberate falsehoods meant to mislead people”.

In Biblical use, breath and soul have a similar meaning, in part due to Greek terms having a larger meaning than can be conveyed in English terms (I believe the appropriate Greek term here is psyche).

In Latin use you may here anima in places such as:

    Magnificat anima mea Dominum

“My soul doth magnify the Lord.”

Klayman is a truly despicable individual, smarmy and weaselly. He used to be a semi-regular guest on Bill Maher’s old POLITICALLY INCORRECT TV show during his anti-Clinton crusade, and he was worse than the other two anti-Clinton loons, Holy Floyd from the Pacific NW and Witchie Witch who ran for Congress.

Klayman is the type of man for whom tar, feathers and rails were invented in the Old West. The type Frank Capra would cast as a villain because he obviously oozes evil. That anyone could for a second put his faith in that reptile is truly beyond my comprehension.

  155. Keith says:

Lupin: Klayman is the type of man for whom tar, feathers and rails were invented in the Old West.

    Not so on any account.

Tar and feathering as a punishment seems to have been first recorded in the Navy regulations during the reign of Richard I (according to Mr. Wikipedia). It was first used in America 1766 in Norfolk, Virginia.

Southerners took great delight in tar and feathering abolitionists before the Civil War.
