Orly Taitz: Who the hell does she think she is?

Orly Taitz: I have an urgent petition to bring before the court.
Judge: The clerk will file the petition with the other urgent Taitz petitions.
Taitz: But your honor, this is an emergency.
Judge: The clerk will file the petition with all the other emergency Taitz petitions.
Taitz: Your honor, you don’t understand. This is of universe-shattering extreme importance.
Judge: The clerk will file the petition with all the other universe-shattering Taitz petitions of extreme importance.
Taitz: But, but, but …
Judge: The clerk will please hand Ms. Taitz the court’s thesaurus.

In this instance, we’re at the opening emergency stage. Taitz says that she filed suit in the US District Court in Honolulu to prevent the cremation of Hawaii Department of Health director Loretta Fuddy, who died earlier this week in a small plane crash. (I was not able to confirm the filing on the US District Court CM/ECF system.)

Who does the hell does think she is?

Taitz is not family, nor law enforcement. She’s not the owner of the aviation company, the FAA or anybody with a personal interest in Fuddy’s unfortunate death. Taitz is exactly nobody, representing no one but herself, and her petition [PDF at Taitz web site] will go exactly nowhere, whether the it’s 1 page or 64.

Somehow having filed birther lawsuits makes Taitz think she has some special privilege. Here she makes this plain:

… Taitz is a plaintiff and co-plaintiff in a nuber (sic) of legal actions. One of such actions is in the state of MS, where deceased Loretta Fuddy was a defendant until the day of her death.

Taitz then goes on do detail other lawsuits of which she (but not Fuddy) is a party. Previously Taitz believed her status as a plaintiff bestowed on her extensive supra-governmental privileges such she stated back in 2010:

“I am uniquely the person to exercise moral power above government, as in Queen of England.”

Sorry, the stricken text was  an April Fools joke.

    I could handle her follies in trying to file or argue legal matters, however this goes beyond decency…

    Is she involved in some kind of ‘performance art’? She released xxxx’s long form birth certificate, destroying much of what Vogt and the CCP have been saying, and then she redirects the birthers’ attention to a non issue in Hawaii.

    Soros could not pay her enough for her services rendered so far. 😉

    Over the years Taitz has been to me just a source of amusement — but harassing people who are dealing with the untimely death of a loved one, that is just despicable. I fear they will feel the need to hire a lawyer to deal with her stupid petition, which is a hassle they really don’t need right now.

    They don’t need it, don’t deserve it and I hope that said lawyer will quickly file the appropriate counter suit. Orly may believe that this will grant her standing for discovery but she will find out the hard way how a legal system works and how a capable lawyer can effectively use the system for what it was designed.

    Would Orly defend herself? I hope the court holds some oral hearings first, in person… Just a believer in Karma points…

    Taitz doesn’t appear to be getting much media (social, internet, or mainstream) attention from this. When she posts about her legal actions, it is usually reposted on RWNJ sites and tweeted by her flying monkeys, but I don’t see much about it yet. Has she finally gone too far, even for birthers??

    It could take some time before officials determine exactly how Hawaii Health Director Loretta Fuddy died, said the lead investigator for the Molokai plane crash.

    It’s common for a cause of death not to be immediately known in these types of investigations, Hawaii-based National Transportation Safety Board investigator Jim Struhsaker said today.

    Fuddy was the sole fatality out of nine people aboard the Makani Kai Air flight that crashed in the water soon after taking off from Kalaupapa on Dec. 11.

    A passenger and the pilot have said they were shocked to hear she didn’t survive because she seemed fine in the moments after everyone got out of the plane and waited in the water for help to arrive.

    It’s been a week since an autopsy was conducted. Fuddy’s funeral is scheduled for Saturday in Honolulu.

    “Most people think cause of death is really simple … and usually it’s not quite that simple,” Struhsaker said.

    Maui police Lt. William Juan has said the NTSB is involved in determining a cause of death. However, the NTSB says that’s up to Maui County.

    “I am the lead investigator over the accident but I don’t have jurisdiction over the county,” Struhsaker said, adding that the NTSB can provide information that will help determine a cause of death.

    The investigation involves interviewing the people who were near Fuddy in the water, Struhsaker said.

    Meanwhile, Struhsaker was making arrangements to ship the plane’s engine in a crate to its manufacturer, Pratt & Whitney Canada, in Montreal, where it will be taken apart for analysis.

    “I know this is a priority item for us,” he said, but noted it may be after the holidays before it can be examined.

    Pilot Clyde Kawasaki said there was a loud bang when the plane lost power in what he described as “catastrophic engine failure.”

    A salvage dive team recovered the engine from the ocean earlier this week. “The Pacific has had its way with it for five days,” Struhsaker said.

    The NTSB could issue a preliminary report 10 to 15 days from the crash, said Eric Weiss, a spokesman for the agency in Washington, D.C. A full report with probable cause and recommendations could take between a year and 18 months.

    There are so many things wrong with this “petition” it will never be heard by the court. The most obvious is lack of standing, because Taitz cannot, as an unrelated person, demonstrate any harm that she herself would suffer. And, as some at Fogbow have noted, she’s moving for a preliminary injunction/stay but she has no case against the mortuary with which this is associated so it is “preliminary” to nothing. A prelim is a procedure to maintain the status quo while a case is being litigated.

    This is fundamental civil procedure covered by ABA accredited law schools in the first year and there is no lack of case law on the topic of injunctions. Of course, we have no idea what that unaccredited distance learning law school taught.

    Doing so would be a form of professional censorship. Lawyers are paid advocates. If the bar reels Taitz in for promoting positions that are perceived as being nuts, this potentially limits opportunities for legal professionals, and also, far more importantly, would limit the ability of those wishing to advance/defend unpopular/fringe positions in the future.

    Not all fringe views are as meritless or repugnant as those of Taitz, far from it. All worthy causes have to start somewhere. Some causes that are initially viewed as aberrant, revolutionary, crazy by society are eventually vindicated and later celebrated. Who is to judge what has merit? The bar association? No. Judges do. That’s why judges exist, and are beholden to separate authority; lawyers advocate, and judges judge their presentations.

    If you want to get rids of Taitz, gots to present some dishonest-to-badness ethics violations.

    Rather ironically, a free market conserv would argue that the market would make such an attorney go away. An “attorney” as shockingly incompetent as Taitz should attract 0 revenue. Unfortunately, the real world doesn’t work that way; a terrible “attorney” may have access to outside capital (hubby’s pockets!) or be willing to burn cash from other sources of income (is that dental practice actually producing anything?) or be able to attract deluded sycophants for clients.

    Here’s another possible avenue …. Taitz’s CLE compliance will be due on 2/3/14. Just over a month away. With all this windmill tilting, has she kept up? She can’t seem to maintain / document anything else correctly, so my money is on “not”. That incompetence has to catch up to her sometime, right?

    As for Orly’s clients, the California Bar won’t initiate an investigation unless one of them complains about her. As far as we know, that hasn’t happened. The only Orly client I can think of who really could show harm as a result of her incompetence was Stefan Cook, and he is dead.

    Hope can spring eternal for eternity, but, the truth is, Taitz is only unusual in the visibility she has achieved. There are thousands of Taitz’s out there, pushing thousands of crazies. Just as love of free speech requires tolerance for unlovely speech, having a legal system that guarantees everyone their say requires tolerance of what everyone has to say.

    And, if she did manage to lose her license … she could go right on birfin’. She wouldn’t skip much of a beat. She would lose the ability to represent others and to pose as an officer of a court, but dozens of other not-a-lawer birfers are clogging the courts just fine having never passed any bar except those surrounded by stools.

    Slowing down Taitz would require removal of access (designation as vexatious, overdue but unlikely), or cutting off her support. Amateur lawyering isn’t terribly expensive—nor should it be—so that’s also a dead end.

    Rickey: A finding of medical incompetence usually results from an investigation following some harm done to a patient. No harm, no foul. Doctors also can lose their licenses for offenses such as failing to maintain proper medical records and for criminal convictions.
