It’s 86° F outside right now (feels like 89) and I just came in from mowing.

    But it didn’t go much past that.

    It’s a bit warmer than that here in Tucson. About a third of our roof blew off on Sunday, and I’ve got two great big industrial dehumidifiers and nine blowers going all around me. Those doggone dehumidifiers put out a lot of heat. But it’s a…dry heat. And of course, when the roof lifted off it took the cooler with it. I just went outside to cool off. It was nice.

    The (undisputed) facts are as follows:

    Under President Hollande, the new Garde des Sceaux (Attorney General, if you wish) is Ms Christiane Taubira, a “black” woman born in Cayenne in French Guyana. Here is her French wiki page:

    Beyond the opposition to her social liberal policies (which I won’t detail here), the French National Front (far right) (FN) also hates her because she is black.

    One vocal member of the FN who was also being pegged to run for local office displayed a picture of a baby monkey and Ms Taubira in a before/after mode on her facebook page. When interviewed on a TV program, she stood by her display and added that she would prefer to see Ms Taubira in a tree where she belongs instead of in the government.

    Faced with public condemnation, the FN then took away their endorsement and the woman in question ended up not running for office.

    In France racist speech falls under the scope of the law of 1881 on freedom of the press (that now includes the internet) which states that “those who […] have advocated discrimination, hatred or violence against a person or group of persons because of their origins or their appartenance or non-appartenance in an ethnic group, nation, race or religion, shall be punished by one year’s imprisonment and / or a fine of € 45,000.. ”

    Ms Taubira considered it beneath her dignity to file a complaint but a local Guyanese association founded by Ms Taubira did. The case was heard in Cayenne in Guyana.

    The verdict came out yesterday. The offending party was condemned to 9 months jail time (not suspended) and a fine of 50,000 euros. The FN was also fined 30.000 euros although there is no provision in the French penal code to fine a corporation of legal entity (as opposed to a physical person) for such an offense.

    The sentences are being appealed, of course. It’s very likely that the fine against the FN will be overturned for the reason mentioned above.

    To provide some context, last April, two antisemites were also condemned to a five months sentence for an antisemitic video posted on YouTube. Last May a far right Breton blogger was condemned to 16 months, but suspended.

    I know such litigation could not take place in the US because of your first amendment, but I (as well as the vast majority of French people) are pleased to see that people who debase the national debate with vile racial invective are prosecuted.

    The Drudge Report on Monday played up a new poll on conspiracy theories by gleefully writing that many Americans are skeptical that Obama was born in the U.S.

    Drudge headlined a Rasmussen poll on how many people believe the Obama birthplace conspiracy theory with, “Shock Poll: 40% Still Not Sure Obama Is American Citizen…”

    Drudge posted the headline quickly before linking to the poll, and later sent readers to Rasmussen’s lighthearted poll on conspiracy theories.

    According to the Rasmussen poll, 23% of Americans said the conspiracy theory that Obama was not born in the U.S. was true, and 17% said they were unsure. 60% rejected the theory.

    There seem to be a lot more conspiracy theories attached to laws and lawmaking than one would expect, mostly because in many cases the law itself contradicts the conspiracy believers and therefore is fair game to them.

    One undying meme in my country is the claim that because the introductory laws for many of our basic laws (the Civil Code, the Criminal Code, the Federal Rules of Civil Procedure ect.) have been repealed, the laws they were introducing have thereby been repealed as well (some even claim “retroactively”), therefore there is no legal basis for traffic tickets or taxes anymore (sound familiar?).

    It’s basically crackpot handwaving that occasionally fools some simple-minded people (but its core intention isn’t just general crackpottery but the attempt to lure people into more legal theories from the same source which always turns out to be ultra right wingers).

    Faced with public condemnation, the FN then took away their endorsement and the woman in question ended up not running for office.

    In France racist speech falls under the scope of the law of 1881 on freedom of the press (that now includes the internet) which states that “those who […] have advocated discrimination, hatred or violence against a person or group of persons because of their origins or their appartenance or non-appartenance in an ethnic group, nation, race or religion, shall be punished by one year’s imprisonment and / or a fine of € 45,000.. ”

    Ms Taubira considered it beneath her dignity to file a complaint but a local Guyanese association founded by Ms Taubira did. The case was heard in Cayenne in Guyana.

    The verdict came out yesterday. The offending party was condemned to 9 months jail time (not suspended) and a fine of 50,000 euros. The FN was also fined 30.000 euros although there is no provision in the French penal code to fine a corporation of legal entity (as opposed to a physical person) for such an offense.

    The sentences are being appealed, of course. It’s very likely that the fine against the FN will be overturned for the reason mentioned above.

    To provide some context, last April, two antisemites were also condemned to a five months sentence for an antisemitic video posted on YouTube. Last May a far right Breton blogger was condemned to 16 months, but suspended.

    I know such litigation could not take place in the US because of your first amendment, but I (as well as the vast majority of French people) are pleased to see that people who debase the national debate with vile racial invective are prosecuted.

    Lupin, I think that the problem is not the First Amendment in itself.

    Europe has similar rules. The European courts do protect Free Speach. France (and her jurisprudence) has still some miles to go to understand this concept completely. Just read here:

    That said, IMNSHO the interpretation of the First Amendment has led into the wrong direction. This could be different. Every one agrees that calling “FIRE” in a cinema is not protected speech. So other utterings could be considered not protected, when they are as dangerous to society as the one mentioned.

    I enjoyed your analysis. If you’ve got a little more free time, I’d be interested in seeing a comparison between comments from a recent article versus those from, say, three years ago. I think it would reveal just how decadent birthers have become.

    By which she means, somebody using a computer at the House offices edited her Wikipedia entry. I have checked into this — it is absolutely true — and in the process I discovered many things, nothing of the slightest importance but all of it entertaining.

    The source Taitz quotes is TodayNews Time and the article begins:

    And it just goes on like that. I have never heard of TodayNews Time before, but it is henceforth going to be my primary source of news.

    If I have deciphered it correctly, the story is that somebody set up a bot that checks every edit to Wikipedia to see if the IP address maps to the House or Senate, and if so, issues a tweet from @congressedits. And one such tweet today resulted from somebody editing the Wikipedia article of noted attorney/dentist/real estate agent Orly Taitz.

    So I took a look at the edit history of that article, and indeed, there is an edit, and the IP address does map to house.gov. And, having caught them red-handed, I can tell you exactly what 1984-ish revision of history some House minion was attempting to perpetrate on the world. The edit was to this part:

    “When Taitz accused the commission of a cover-up, Dan Dumezich, the Merrillville Republican who is chairman of the commission, told her that if she was disrespectful one more time, ‘your butt is going to be gone.'”

    And our mysterious Congressional editor changed “Merrillville” to “Schererville.”

    That’s it. That’s what Taitz is making a fuss about.

    Perhaps time has dimmed my memory of some specific statement, but I’m fairly certain, on general principles, that Birdboy is wrong about Reagan saying that American citizens are protecting evil from being taken over by the elites.     Well, it could be nefarious: perhaps some Congresscritter who represents one town, but not the other, wanted to (not) be associated with the statement.

    I think Boehner needs to empanel a Select Committee to settle this Extremely Important Matter™ by identifying Mr. Dumezich’s true residence, and determining whether it lies inside, or outside, the boundaries of the district of the Honorable Member whose office made the change.

    Orly should encourage this, as it might be her only chance ever to get (the equivalent of) discovery.

    The difference is, network decay occurs because the network realizes it can appeal to more viewers and make more money by not being a niche channel. Birthers aren’t trying to increase market share, they are branching out because they’ve run out of things to say.
