Docket Updates

A trio of updates to the Docket recently:

  • Cook v. Good: It has been dismissed in Georgia. The federal judge declared the issue moot. Orly got some publicity.
  • Kerchner v. Obama: Mario Apuzzo, waiting until the last minute, files his 40-something page rebuttal to the government’s motion to dismiss. Warmed over Berg, says Bob.
  • Hamblin v. Obama: The government has filed its motion in Arizona District Court, saying the President had not been properly served and that the case should be dismissed for lack of standing in the first place. Serving the President is really easy, and they tell you how!

    The govt’s motion in Hamblin cites other birther cases.
    “Further, this suit is nothing more than a generalized grievance by the Plaintiff as a
    member of the public at large. As such, he lacks standing, this Court lacks subject-matter jurisdiction, and this case should be dismissed with prejudice sua sponte. Indeed, that is precisely the conclusion reached by the other courts considering these absurd challenges to President Obama’s citizenship.”

    They cite 5 or 6 birther cases including Berg vs. Obama and Hollister vs Soetoro. Funny, the birthers thought by filing many cases they would eventually have one stick, instead, they are building a case precedent history that can be used against them.

    I know when there was a draft, it was a crime to encourage or counsel someone to resist/refuse to cooperate. Isn’t there something similar now?

    How is she getting away with this?

    This is the same Colonel- I looked him up and he is a reservist and a doctor- who has been writing these things for months. My husband who is retired works with active duty military on an installation and he tells me that he has heard nonthing of this birther idiocy. If this Colonel is the only response she has had then she hasn’t had much. She may get a few other idiots to join her. This sickens me because we depend on an apolitical military that can be trusted. These folks as few and far between as they are undermine that.

    Michelle Malkin has written extensively against anchor babies. Unfortunately for her, she and Jindal were anchor babies.

    The only way Taitz got out of the Soviet Union, was to declare she wanted to go to Israel. Once there, as a refusenik, she was given subsidized housing, mortgage, and tuition.

    She took everything offered by the Israeli government, and legislated by the Laborites – which is what the Socialist Party evolved into. And now she is denouncing liberalism, and feeding the extreme right wing. Disgusting.

    She doesn’t realize she is playing with fire.

    You want to see bad? Look at Connerat v. Obama ( http://www.therightsideoflife.com/?p=6502 ). The filing that is included is hysterical. This is what the wingnuts are pinning their hopes on for removing a legally elected, eligible President? Bwahahaha.

  7. You think that one is bad. I almost cracked up when Obama’s lawyer cited Roy v. Obama in a response as an example of “failure to state a claim.”

    Wow. I wonder if the birthers are re-thinking quantity being such a good thing now seeing how easily it can be used to argue against them. OT, but did anyone else see Lynn Cheney stoking the crazy last night on LKL? Holy Gawd, she smirked the whole time. She is definitely daddy’s girl. The neocons know the birther cause is a monster on the loose. Whether they realize they can’t control it is another matter. But I am starting to think they are a bigger threat to the GOP than to the Obama Admin.

    Orly is convinced she can control it, which is why she is making common cause with anti-Semites.

    As I wrote before, when she is no longer useful to them, they will turn on her. She is playing with fire. Even my cat knows better.

    It’s going to be fun to watch when they crash and burn. She and Berg are already going after each other.

    What she and her coterie is proposing is fascism in the literal sense, not what the loonies are accusing of Obama.

    Orly forgets how terribly Jews fared in a totalitarian state. Posters on her site have called for a coup, for mob rule, and government by fiat – and she tolerates that.

    In this case, fiat does not stand for Fabbrica Italiana Automobili Torino. (bada-bing)

    The worrying thing is, though, that these people appear to be violent dengerous nutters. I hope she’s on some angency’s watch list.
